NEED ADVICE on Carfax, used car problem.I purchased a used BMW 330xi 4 months ago for 30000.?

1 month later found out we were expecting 2nd child and needed something with more room. After searching around we went to a dealership last week and were in the middle of the transaction when the carfax came in stating that our vehicle had hit another vehicle in 3/2007. Dealer said it was front end and repainted from what they could see. Sugguested we go back to purchasing dealer as they should have informed us. We went back to this ';reputable'; dealer in our area and informed them about the problem. They called carfax and were faxed some type-in explanation from the seller stating that the vehicle had been ';keyed'; and repainted on the doors. The next day carfax sent a letter stating that they didn't get the report of the accident until 1/08 (three week AFTER our purchase). The place where we purchased it said they would give us only 21000 for it as a trade in even if we were going to purchase 44000 NEW car from them. Dealer didnt know, so its not their fault. Carfax did not have the information until after you bought, so its not their fault. Cant pursue the original owner, they had no obligation or interaction with you. Cant pursue their insurance, because they did report it, just not in time for you to find out.





a 330xi is plenty of room for 2 adults and 2 kids. Make the payments on this car, get financially in line, then think about something else. You will be much better off in both the short and long runs.NEED ADVICE on Carfax, used car problem.I purchased a used BMW 330xi 4 months ago for 30000.?
Who would you sue?? The dealership you bought the car from didn't know about the damage, so how can you hold them responsible?? It sucks, bit there's not much you can do.
CarFax didn't know until a week after you bought the car. How do you expect the dealer to know about it when he sold you the car if there was no public record of it at the time he sold it to you?





Get an attorney for what purpose? To sue the dealer for not having ESP and knowing a report would come in a week after the sale?





And even if your BMW was keyed and repainted, how is that impacting your life? Was the paint job done correctly? How does what the dealer will give you trade tie in in any way to the repairs done on the car? If the car was fixed as good or better than it was before the incident, that won't drop the price any.





If you don't think the trade is fair, try another dealer.
I totally agree with the first two answers. Although it's unfortunate, there is nothing that could have been done to prevent it. The dealer probably ran a carfax when they took it in, it was clean, so they paid top dollar for the car. You came along, saw the carfax was clean and paid top dollar for the car. It's nobody fault really. It's just unfortunate. Regardless, the 330xi is an awesome car, keep it and figure out a different way.
Was this dealer basing his $21000 offer on the fact that the car was repainted? Ask them what the price would be





A) Without the repairs (keyed but never fixed) or


B) Never been keyed, factory paint.





Forget the attorney, this isn't something you sue over. Get over it. It wasn't fraud and it wasn't deception. It was a case of bad timing. Carfax isn't perfect.
Go to an attorney and have him go through CarFax's guarantee. They advertise it all the time, hold them up to it.
