Anyone have advice on my Debt Collector problem?

I was contacted by Mr. Flores ( and that's the name he gave me) about paying off a credit debt on a Disc. Card. First I tried to explain to him that I do not have a Discover Card and was never sent statements, or any letters from a collection agency. He then proceeded to tell me that I am beyond that point and the company hired him I guess to see if I want to proceed on going to court or take this last chance to settle. That the limit was 5000 and what was used was 2200 and that he can cut the payment and i can pay 900 by 10/30/09 or 254.71 for 5 months. He then asked me for my account information ( I panicked and lied and said I have a bank account but don't have checks or a debt card.) I then told him I would pay using money orders and that I wanted letters in mail also that he is agreeing to this but he said I cannot use mail in payments and that I am far beyond being able to receive any letters in the mail ( of coarse regarding this conversation). He then said for me to call him tomorrow, and give him the account info or it will be documented as fraudulent means of trying to pay off this debt or somewhere along those words. Can someone help me, I know I had credit debt but NOT with a Discover Card. and I don't want to go to court. Is this REAL? I need advice!!!! i wouldnt believe that they are going to take you to court and i dont believe that you owe Discover any money. this sounds like they are trying to be fraudulent to you. dont give this guy any money or any account numbers!!! If they are really at the point where they are going to take you to court, let them send you something in the mail with your date and time and that stuff. then go and tell them you are the wrong person. dont get scammed yourself!!!Anyone have advice on my Debt Collector problem?
You should have never called him. That is a collections Agent. If something goes to collections you should always call the company you owe directly never the collection Agency.





Now, they will take you to court because they know you have the monies. You need to find a lawyer.

if it were ME, i'd call the CC comp %26amp; investig8 the matter. if u don't have a discover card, then u really don't owe on it. i'd also get me a good atty 2 help. u can also stop the collector from ever contacting u again by telling them 2 cease contact
I'm actually more confused than you (if that's possible). After you determined that you did not have a Discover Card, what was the point of further discussion.
Contact an attorney that specializes in credit collections... you may be able to sue them. Good luck and never talk to collectors over the phone, they try to intimidate. Use mail, this way there is a paper trail.
That sounds so shady! Don't give your account #'s to anyone. Pull your credit report and see if the Discover account is listed. If it is you need to take action, someone could have opened an account in your name. If you don't see the it, call discover and tell them the story, give them the # Mr. Flores told you to call him back at.

Read the fair debt collection practices act(google this). It will tell you your rights. DO NOT GIVE HIM YOUR ACCOUNT INFORMATION. Request a debt validation including full account history, proof he has the right to collect on the debt and a copy of the original contract. First tell him this when he calls back then send a certified letter with return receipt stating this. You can look around on line for samples of debt validation letters.





Tell him you will only have contact via US postal service. After you tell him this then tell him not to contact you by phone again. Then hang up.





Debt collectors will tell you anything to get the money. Read the fair debt collection practices act. Know your rights. Only deal with them via certified mail.





Do not forget to follow up with the certified letter.
if you truly do not and have not had a discover card - don't worry about it and after they summons you to court and find out that your not the write person, get them for harassment. So why did you say anything about you are going to pay them if you say you don't have an account with them?





one other thing to do is to have him verify the SSN - usually they can do that by the last 4. I would call discover card directly and bypass Mr. Flores
