Your employer must have a good reason for dismissing you, and has to show that the reason is genuine and justifies your dismissal. One of those reasons can be your capability - this means that you can't do your job properly, or aren't performing to the required standard, eg because long-term or persistent illness makes it impossible for you to do your job. If you are persistently off sick (or long-term sick), your employer should normally look at any alternatives before deciding to dismiss you. For example they might have to consider whether the job itself is making you sick and needs to be changed. Your employer would normally be expected to allow a reasonable amount of time for you to recover from your illness. Also, if you have a disability (which may include long-term illness), your employer has a legal duty to try to find a way round the problem by making 'reasonable adjustments' to how and/or where you work. Dismissal because of a disability may be unlawful discrimination.Visit the excellent website below for further help and information, plus links to other helpful sites, such as ACAS.Need legle advice because i have amedical problem(gynicolighist) and work being arkward even with medical note
My boss has also recently started being funny with me. i started having really bad pains in my head across my eye i went to the doctors and was told to get the hospital asap, when i arrived i had a ct scan and was booked in for an mri at a later date. i also had blood tests done
i later found out i have a tumour on my pituatry gland and am awaiting further information on the decided treatment plan.
i was havin hours a day to go the doctors and hospital, unfortunatly i work 8-6 so am unable to do it out of hours
anyway they got real impatient and told me i could only have an hour a month
so i got legal advice form citizens advice and they drafted me a letter to give to my boss about me having a long standing illness adn also the severity of it so they are a little more understanding now
good luck
emma
legally they can,t let you go for a medical problem if it is not contagious or affecting your performance at work=if you are quite sick, you can take a leave of absence and that job is to be there for you when you are able to work again =good luck
